RESPONSABILITIES
The Company acts only as an intermediary agent for the client. Its function is to arrange, in the name of the Client, the services provided by airlines, bus companies, train companies, cruises and any other transport operator in general, hotels, tourist operators and/or any other independent company.
The Company does not have any control on these companies, and that is why in all the arrangements of trips it acts by account and order of the Client, organizing in its name the different type of transportation, the required lodging and other tourist services. The Company does not assume the responsibility in case of accidents, insults, losses, damages, delays, disadvantages or any other type of irregularities that can be caused by failures of any vehicle or through situations of omission or negligence of any company or person contracted by the same ones to comply or execute any service or part of an offered tourist service as result of vandalism, strikes, wars, governmental actions, climate conditions, God acts or any type of factors that imply additional expenses which result from delays, changes in itineraries or any other cause.
The Company is not responsible for diseases, pregnancies or handicaps that can put in danger the health or the integrity of the Client or third parties during the process of the contracted tour / excursion or that imply limitation or impediment for the benefit of the tourist services. Therefore the Company will NOT recognize any reclamation nor money return for the above-mentioned concepts, including the cases in which, under usual conditions, no problem would arise. Therefore if there is any limitation like the above mentioned, we ask you to inform us before contracting our service so we can recommend you specific alternative services to the present impediments.
All Clients are expected to assess that their physical fitness aligns with the requirements of the itinerary of their choosing prior to booking. The Company reserves the absolute right to decline a booking at their discretion. Clients agree to accept the authority and decisions of the employees of the Company, tour leaders, agents and guides, while on the tour with us. If in the opinion of such person the health or conduct of a Client before or after departure appears likely to endanger the safe, comfortable or happy progress of a tour, the Client may be excluded from all or part of the tour.
The Company reserves the right of accepting or not any reservation request of any Client asking for any tour, hotel or tourist package or to cancel or change a tourist package if the circumstances are not the appropriate. The request for any type of service presented to our company will be understood as the approval for the mentioned conditions.
The Company acts only in the capacity of an agent upon the legal conditions that, while exercising every possible precaution, it is not responsible for injury, sickness, damage, loss, additional expenses, accidental delay, or other irregularities which may be caused either through willful or negligent acts or omissions made by the companies or individuals providing or engaged in transportation, accommodation or other services related to the accomplishment of the tour, or through natural disasters, social upheavals or other causes.
BOOKINGS
In order to secure a booking with the Company, the Client must deposit at least 50% of the entire tour package price. Some tour packages, which include cruises, treks or particular hotels, with unique characteristics, are subject to special deposit policies. The deposit is non-refundable. All Clients will be deemed to have read the booking conditions. It is also necessary to count with the following information, for all the passengers, in order to secure a booking: full names (as they appear in the passport), number of valid passport, nationality, birth date and sex; and a scanned copy of the valid passport.
Anyone suffering from illness or disability or undergoing treatment for any physical or medical condition must declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication or other treatment which may be required during the trip. Failure to make such disclosure will constitute a breach of these booking conditions and result in such persons being excluded from the tour package in which case all monies paid will be forfeit.
All bookings will be subject to confirmation until the Company has received the deposit completing the remaining balance of the tour package AND a confirmation email has been send to the Client specifying what has been booked. It is just at this point that a binding contract between the Company and the Client comes into existence. In case of special signed agreements between the Company and the Client, the booking conditions could differ from above.
The person receiving the confirmation email with the booking confirmation warrants that he/she has full authority on behalf of all the people travelling with him/her and confirms that all such persons are fully aware of and accept these conditions.
Payments for our services can only be made according to the indications specified in our payment methods. The prices and rates could change without previous notification until the services have been totally canceled and reconfirmed.
PRICES AND RATES
All the prices and rates are expressed in United States American Dollar and are subject to changes without a previous notification until the total payment has been received by the Company AND a confirmation email has been send to the Client specifying what has been booked. The prices and rates of the tour packages usually are considered per person, on a double occupation basis (except for express different indication), in standard rooms and include transfer services, transportation, mentioned guided tours and excursions, mentioned meals, specialized guides and most entrance tickets (if no other conditions are indicated). The prices and rates do not include extra expenses, tips, airport taxes, air tickets (except for express indication), excess luggage or any other issue not specified in the tour package.
PAYMENT
Our payment policy for individual passengers states that the balance of the amount due must be paid to the Company no later than 45 days before the day established as the starting day of our services, unless express different agreement (different policies may apply for specific bookings). For groups, our payment policy states that our services must be fully cancel 60 days before the arrival of the group and MUST send the list of passengers or rooming list (full names, valid passport numbers, nationalities, birth dates and scanned copy of each valid passport), unless express different agreement (different policies may apply for specific bookings). In the case of bookings made within 45 days of the departure date, the full amount of package price has to be paid at once. In case of non-payment of the balance by the due date, the Company will treat the booking as cancelled by the Client. Any modification to the agreed services or new require services once the tour has started will need to be requested to the Company and will be paid directly by the passenger to the Company’s representative; only under special conditions agreed by the Company the extra costs could be charged to a credit card.
Our prices and rates do not include Peruvian sales taxes (18%). Those exempt from paying this tax must meet the legal standards. At this moment ONLY foreigners not residents in Peru are exempt. The passenger (guest) must prove he or she meets the legal standards honored in Peru by showing a valid passport or any other valid national identity card AND the TAM (Andina Migration Card). Please note that visitors who have stayed in Peru longer than 60 calendar days are no longer exempt from paying this tax.
Payment Methods:
Unless a special written agreement has been signed, all the services must be paid as follows:
a) Wire Transfer: By sending the transfer in the name of TEMPO TOURS S.A., according to theinstructions(all wiring and transfer costs should be assumed by the Client). A copy of your transfer must be emailed to sales@perutravelsolutions.com in order to check the receipt of the funds with our bank.

b) Credit Card (Visa, Amex or MasterCard): It is necessary to print, complete and sign this form and emailed it together with a scanned copy of your credit card (both sides) and a valid passport to: sales@perutravelsolutions.com
c) Pay Pal (paypal.com): Is a secure online payment processing service that stores and safeguards your bank, credit or debit card details, allowing you to pay safely and easily without sharing any of your financial information with us. The client will receive an email with the invoice, he will log into his PayPal account (if he does not have an account he will be able to create one free at the moment of paying) and he will pay with all major credit cards or his PayPal balance.
BOOKING MODIFICATIONS / THE CLIENT
Any changes to the original booking must be requested by the Client through email, while warranting that he/she has full authority on behalf of all the persons travelling with him/her and confirms that all such persons are fully aware of the request. For any change by the Client to the itinerary after receiving a confirmed Travel Program from the Company, a US$50 changing fee will be charged plus any costs or charges which are incurred or levied by our suppliers as a result of the amendment. While every reasonable effort will be made to accommodate changes and additional requests, their availability cannot be guaranteed.
If any member of your party is prevented from traveling, it may be possible to transfer the booking to another suitable person, provided that written notice is given at least 45 days before the day established as the starting day of our services. An administration fee of US$50 will be levied plus any costs imposed by the Company’s suppliers. In the case of air, train, cruise or bus tickets the Company will make its best effort to transfer the booking, but it will depend on these suppliers own policies.
BOOKING CANCELLATIONS / THE CLIENT
Individual Passengers:
- The Client may cancel the booking at any time provided that the cancellation is communicated to the Company in writing. If a request is received until and including 60 days before the day established as the starting day of our services, the devolution or reimbursement will be subject to a penalty of 10% of the paid amount for administrative expenses, without taking into account the financial expenses related to the cost for the bank transfer, commission of the credit card and any other expense and/or cost related to the devolution. However, in case of canceling tour packages which include any transportation service already issued (airlines, trains, cruises or buses), specific services like Inka Trail or lodging in certain hotels no reimbursement or devolution will be granted for these services, given these suppliers own policies.
- The Client may cancel the booking at any time provided that the cancellation is communicated to the Company in writing. If a request is received until and including 45 days before the day established as the starting day of our services, the devolution or reimbursement will be subject to a penalty of 25% of the paid amount for administrative expenses, without taking into account the financial expenses related to the cost for the bank transfer, commission of the credit card and any other expense and/or cost related to the devolution. However, in case of canceling tour packages which include any transportation service already issued (airlines, trains, cruises or buses), specific services like Inka Trail or lodging in certain hotels no reimbursement or devolution will be granted for these services, given these suppliers own policies.
- The Client may cancel the booking at any time provided that the cancellation is communicated to the Company in writing. If a request is received until and including 30 days before the day established as the starting day of our services, the devolution or reimbursement will be subject to a penalty of 50% of the paid amount for administrative expenses, without taking into account the financial expenses related to the cost for the bank transfer, commission of the credit card and any other expense and/or cost related to the devolution. However, in case of canceling tour packages which include any transportation service already issued (airlines, trains, cruises or buses), specific services like Inka Trail or lodging in certain hotels no reimbursement or devolution will be granted for these services, given these suppliers own policies.
- No devolution or reimbursement will be granted if the cancellation request is received 29 days or less before the day established as the starting day of our services. Also, no devolution or reimbursement will be granted if the passengers do not appear or if they cancel the service during the trip. There is no reimbursement or devolution for part of the tour packages or stays not used.
Group of Passengers:
- The Client may cancel the booking at any time provided that the cancellation is communicated to the Company in writing. If a request is received until and including 75 days before the day established as the starting day of our services, the devolution or reimbursement will be subject to a penalty of 25% of the paid amount for administrative expenses, without taking into account the financial expenses related to the cost for the bank transfer, commission of the credit card and any other expense and/or cost related to the devolution. However, in case of canceling tour packages which include any transportation service already issued (airlines, trains, cruises or buses), specific services like Inka Trail or lodging in certain hotels no reimbursement or devolution will be granted for these services, given these suppliers own policies.
- The Client may cancel the booking at any time provided that the cancellation is communicated to the Company in writing. However, in case of canceling tour packages which include any transportation service already issued (airlines, trains, cruises or buses), specific services like Inka Trail or lodging in certain hotels no reimbursement or devolution will be granted for these services, given these suppliers own policies.
- No devolution or reimbursement will be granted if the cancellation request is received 44 days or less before the day established as the starting day of our services. Also, no devolution or reimbursement will be granted if the passengers do not appear or if they cancel the service during the trip. There is no reimbursement or devolution for part of the tour packages or stays not used.
- Certain suppliers have more rigorous cancellation policies related to groups of passengers. Therefore in the reservations made by groups which exceed 10 passengers, the Company will reserve the right of imposing a penalty of 25% until 90 days before the day established as the starting day of our services, and 100% for annulments until 45 days before the day established as the starting day of our services. During the high season, our company reserves the right to alter the cancellation policies if our suppliers apply several penalties besides the above mentioned ones.
BOOKING MODIFICATIONS AND CANCELLATIONS / THE COMPANY
The Company will use its best endeavors to operate all tours as advertised. Although the itineraries are planned with great care, due to operational reasons or local conditions, it may be necessary to change the sequence of activities, the specified route or cancel part of the tour, and though such cases are rare, in general the itinerary should be treated only as a basic guideline. Consequently the Client accepts that it may prove necessary or advisable to vary, modify or cancel a tour itinerary or its contents due to prevailing operational reasons or local conditions.
The Company reserves the right at any time to cancel or change any of the facilities, services or prices (including flights, accommodation or other arrangements) and to substitute alternative arrangements of comparable monetary value without compensation and accepts no liability for loss of enjoyment as a result of these changes.
If a major change is known to us at the time of the booking, the Client will be informed immediately. If a major change becomes necessary after booking, the Company will inform the Clients as soon as reasonably possible. Therefore, the Client will have the choice of accepting the change of arrangements, purchasing any other available tour or canceling the tour and obtaining a full refund. This is providing that the major change is not because of FORCE MAJEURE.
FORCE MAJEURE: is war, threat of war, riots, civil strife, industrial dispute, terrorist activities, natural or nuclear disaster, fire or adverse weather conditions, technical or maintenance problems with transport, changes imposed by cancellation or rescheduling of flights by an airline, the alteration of airline or aircraft type, or other similar events beyond the control of the Company.
The Company is not liable for any charges in the event of a change – beyond their control – to the departure time or date of a tour, flight or other form of transport. As certain services could be interrupted or canceled due to climate conditions, reasons of greater force, God’s acts, disturbances, etc. or others out of hotels, airlines, providers or agency hands. No devolution or reimbursement will be granted as result of these interruptions or cancellations totally out of our control.
TRAVEL DOCUMENTATION
It is the responsibility of the Client (passengers) to be in possession of a valid passport, visa permits, inoculations and preventive medicines according to his / her nationality and accepted by the laws of the countries to be visited, as may be required by the authorities of the visited countries for the duration of the tour. Information about these matters or related items is given in good faith but without responsibility on the part of the Company.
LOCAL LAWS
All participants in tours operated by the Company are expected to obey the laws and regulations of the countries visited and any failure to do so will relieve the Company of all obligations that they may otherwise have under these booking conditions.
COMPLAINTS
If the Client has a complaint about any of the tour package arrangements, he/she must bring it to the attention of the tour leader or other representative of the Company at the appropriate time so that they may use their best endeavors to rectify the situation. It is only if the Company is made aware of any problems that there will be the opportunity to put things right. Only making your complaint known at the moment will allow us to remedy the situation or facilitate compensation. If the problem remains unsolved, a complaint must be made in writing to the Company within 30 days of the completion of the trip.
FLIGHT BOOKINGS INCLUDE IN TOURIST PACKAGES
The Company will use its best endeavors to ensure that all flight fares are correct at the time that they are quoted. Airlines reserve the right to amend or withdraw fares without prior notice. Once a deposit is paid on an airfare, it guarantees that a booking is being held for you, it DOES NOT GUARANTEE the fare. The fare can only be guaranteed when the flight booking has been paid for in full and a ticket has been issued. Flight bookings cannot be transferred. The Company cannot be held responsible for any delay to your flight whether this delay is caused by adverse weather conditions, the action of air traffic controllers, airport authorities or (local) governments, the rescheduling of flight times by the airline, mechanical breakdown, strike, industrial action or any other reason.
CRUISE BOOKINGS INCLUDE IN TOURIST PACKAGES
The Company will use its best endeavors to ensure that all cruise rates are correct at the time that they are quoted. Once a deposit is paid on a cruise, it guarantees that a booking is being held for you and the rate. Cruise bookings usually cannot be transferred. The Company cannot be held responsible for any delay to your cruise whether this delay is caused by adverse weather conditions, the action of port authorities or (local) governments, the rescheduling of cruise times, mechanical breakdown, strike, industrial action or any other reason.
TRAIN / BUS BOOKINGS INCLUDE IN TOURIST PACKAGES
The Company will use its best endeavors to ensure that all train and bus fares are correct at the time that they are quoted. Train and bus companies reserve the right to amend or withdraw fares without prior notice. Once a deposit is paid on a train or bus fare, it guarantees that a booking is being held for you, it DOES NOT GUARANTEE the fare. The fare can only be guaranteed when the train or bus booking has been paid for in full and a ticket has been issued. Train and bus bookings usually cannot be transferred. The Company cannot be held responsible for any delay to your train or bus service whether this delay is caused by adverse weather conditions, the action of land traffic controllers, land transport authorities or (local) governments, the rescheduling of services times by the train or bus companies, mechanical breakdown, strike, industrial action or any other reason.
